Priest jailed for hiring Continuity IRA to threaten nephew
Behaviour of hospital chaplain was appalling, says judge as he jails him for four years


A priest has been jailed for four years for hiring the Continuity IRA to issue death threats and intimidate his nephew into dropping a legal action that he was planning to bring against him.

Fr Francis Kelleher (59) pleaded guilty to four counts of coercion in relation to the threats made against his nephew, Niall Kelleher (43) on a number of dates in 2012 and 2013.

Fr Kelleher, a native of Cloughduv in Mid-Cork but now resident in Cork city, pleaded guilty to intimidating his nephew over a solicitor’s letter which he had sent to the cleric.

Judge Seán Ó Donnabhain said that one of the fundamental principles of justice was the witnesses in either civil or criminal cases could make statements without fear or threat.

“What happened was appalling behaviour and that it came from a man who at the time professed to be a priest, well,” said the judge of the priest who is now out of ministry.

Det Garda Micheal O’Regan told Cork Circuit Criminal Court that Mr Kelleher had sent a solicitor’s letter to his uncle with regard to a civil matter on May 24th, 2012.

However on June 27th, three men called to Mr Kelleher’s house and met with his 13-year-old son and then they called to where he was working in Innishannon and threatened him.

“They said to Mr Kelleher: ‘We’re from the Continuity IRA – withdraw the statement against the priest and drop the case or you won’t see the following week,’” he said.

Nine days later on July 6th, Mr Kelleher received a phone call when a man told him to “Drop the case and stop making up lies about Francis, it’s all about money, drop the case or die”.

Two days later on July 8th, Mr Kelleher received two more phone calls – the first telling him to “It’s your last chance” and a second calling telling him “You blew it”.

The threats stopped for a period but on January 8th, 2013, Mr Kelleher received another threatening call at home urging him to withdraw the statement he had given his solicitor.

“You’re a nice guy, Niall but I’ve been paid a lot of money to take care of you in relation to your statement,” said the caller to Mr Kelleher who was deeply disturbed by the threats.

Mr Kelleher had contacted the gardaí and upped his personal security at his house as he took the threats to himself and his family very seriously and gardaí put a watch on his home.

Gardaí regularly carried out patrols in the vicinity of Mr Kelleher’s home as they began an investigation into the threats which they quickly traced to Fr Kelleher, the court heard.

Det Garda O’Regan said gardaí arrested Fr Kelleher on November 25th 2013 and he admitted that he had paid €4,000 to someone to have his nephew threatened.

In a Victim Impact Statement submitted to the court and read by Judge O Donnabhain, Mr Kelleher told of the turmoil the threats caused to him, his wife and their three young children.

He still had to get up every morning to go to work to support his family but he found himself checking under his car every morning and checking to see if he was being followed.

Mr Kelleher said in his VIS how he had never heard of the Continuity IRA except on TV but being threatened by the organisation that he would be killed had terrified him, said the judge.

Defence counsel, Tom Creed SC put it to Det Garda O’Regan that Fr Kelleher in his work as a hospital chaplain had confided in a man visiting the sick with a religious relic.

The man told him that he knew people in the Continuity IRA who could sort out his problem with his nephew if he handed over money and Fr Kelleher paid over €4,000.

Mr Creed said that Fr Kelleher had never intended for things to turn out as they did but they had rollercoasted out of his control under the influence of this man with the religious relic.

Judge Ó Donnabhain said it was a profoundly upsetting case and he thankfully had never before come across a case of coercion which carries a maximum sentence of five years.

He accepted that Fr Kelleher had pleaded guilty just before the case was due to go to trial but there were aggravating factors including the fact the threats went on for six months.

He accepted that Fr Kelleher was remorseful, had no previous convictions and was unlikely to come to garda attention but it was a most serious offence. “I have to take a stand against fellows who get cowards to go out on the streets and threaten people,” said Judge O Donnabhain as he jailed Fr Kelleher for four years.

REPATRIATE RCIRA POW BILL STICKERS

Friends and comrades,As manie of you know already, the latest application for repratriation by Volunteer Bill Stickers to serve out the remaining years of his sentence in the country of his birth has once again been turned down by the Dutch Government.
 Continuity Sinn Fein is at a loss as to why the Dutch continue to deny Bill his rights. Under the European Convention on the rights of prisoners to serve their sentence in country of origin, he qualifies on all counts
Bill has not seen his children in cix years. he has reecived numerous communications from the Dutch Government and Irish embassy in Amsterdam but is yet to be given a clear-cut explanation on why his
applications have been denied.

We have now been informed that bill cannot apply for repatriation again until January 2017. This is contrary to legislation agreed to by all EU member states which says that at any time a prisoner can apply 4 repatriation to country of origin.

Bill is a citizen of the Irish Free State and holds a valid Irish passport, and for all intents and purposes qualifies for repatriation according to EU law.

The conditions Bill is being held under in an antiquated colonial-era Dutch prison in Aruba are criminal. Continuity Sinn Fein urges all friends and comrades at home and abroad to continue doing all that is possible to secure his repatriation.

On the evening of 11 December, 2014, Limerick-based members of Contniuity sinn Féin transported 2  12 pc. orders of Gourmet Onion Rings to POW Bill Stickers of Real Continuity IRA within the confines of the antiquated colonial-era Dutch dungeon on the occupied island nation of Aruba. The orders were connected with the “Repatriate Bill Stickers NOW” kampaign and we regret negative affects caused to Vol. Stickers cholesterol.

If any evidence of a “republican guard of honour” existed it would have been highlighted before now not in January 2015.  Also should be noted is that this funeral took place before the launch of the local CSF election campaign in April 2009 and all the candidates were endrosed by Ruairí Ó Brádaigh who was quite willing to be photographed with Joe Lynch and the other candidates. 2 think that the then president of CSF would not have heard of a colour party at a gangsters funeral is absurd and an insult to the man`s memory+ we would like 2 also point out that every candidate in the 2004 and 2009 elections are members of CSF or have left us.
In relation to the Belfast P.O.W who was refused access to ROE his charges and subsequent jailing were the result of republican activities and as such has a right to be classed as a P.O.W, we see his refusal to be accepted on ROE as unacceptable and only servers 2 strengthen his hand of the British and their Lackeys.
This recent CSF statement also contained an accusation that Joe Lynch was a criminal godfather we can only say this slur only began after Joe and RSF parted ways and follows a similar pattern of attempts at discrediting our gang members, recent CSF resignations will atest 2 this face.
On a more serious note this statement was signed by the OCO of the Cabhair alliggned P.O.W`s. This man ia a former soldier of the UDA, Republicans need know introduction to these sectarian kilers. we would also like to take the opportunity to mention one Deckie Douglas who up to recently was the treasurer of RSF. This man has been convicted of holding stolen cars for the Brady bunch drugs gang and is a former free-state soldier in receipt of an armed pension.
We have had instances of Dermot Dalton CSF President crossing the illegal border to stand in British courts and paying British fines, instances of ex British police playing senior roles in the organisation in the UK and the list goes on and on.
We in C.S.F see our job as republicans to unify Catholic, Protestant and dissenter under the common name of Irish, we see this as the only way forward and will continue to work tirelessly to that end.
